1. The Client Who Requested the Help of a Labor Attorney

The client who requested help from a labor attorney was in a situation in which he had been indicted on the charge of violating the Occupational Safety and Health Act due to an accident involving the death of a worker.
Wishing to avoid a custodial sentence above all, the client sought out a specialist labor attorney and visited Daeryun Law.
The Occupational Safety and Health Act as Explained by the Labor Attorney
The client who came to a Daeryun labor attorney was a business owner who comprehensively oversaw and managed matters concerning the safety and health of the workers belonging to the company, and was in a situation in which he had been indicted for failing to take the measures necessary to prevent 🔗an industrial accident.
The Occupational Safety and Health Act sets out the safety and health regulations that a business owner must observe and includes various measures to protect workers' rights.
Through this statute, a business owner can create a safe working environment, and workers can recognize and exercise their rights.

A person who, in violation of the Occupational Safety and Health Act, causes the death of a worker shall be punished by imprisonment with labor for not more than 7 years or by a fine not exceeding 100 million won.
2. Assistance Provided by the Labor Attorney
To defend against the client's punishment, the labor attorney established a strategy of admitting the negligence while requesting leniency.
Labor Attorney Assistance 1: Argument Acknowledging the Negligence and Showing Improvement
The labor attorney argued that the client was deeply remorseful about the accident and that, although the client was in a very difficult financial situation, he was making efforts toward improvement by spending approximately 10 million won to newly install equipment related to the accident and by hiring personnel for safety management.
Despite the fact that the client's company is currently in a difficult financial situation, the client made efforts to improve the site using loan funds.
The labor attorney also emphasized that the client took steps so that the victim's bereaved family could receive survivors' benefits, funeral expenses, and the like after the victim's death, and that the client paid the bereaved family separate compensation for the loss.
Labor Attorney Assistance 2: Argument That the Victim Did Not Comply with the Safety Rules
The labor attorney argued that, while the client, who bore responsibility for the workplace's safety, acknowledged his fault, the victim was also at fault for not wearing safety equipment.
The Daeryun labor attorney argued, using the in-house safety guidelines as evidence, that the client had regularly conducted safety-related education.
3. Result of the Labor Attorney's Assistance: Successful Defense Resulting in a Suspended Sentence
As a result of the Daeryun labor attorney's assistance, the client was able to avoid a custodial sentence even in connection with the worker's death.
The client said, "In the case of an accident involving the death of a worker, one can be subject to heavy punishment, so I was extremely worried. With the help of the Daeryun labor attorney, I was able to avoid a custodial sentence."
