1. The Client Who Came to the Anyang Attorney

Road Traffic Act Article 148-2 (Penal Provisions)
(1) A person who, having been sentenced to a fine or heavier punishment for violating Article 44 (1) or (2) (limited to cases of operating a motor vehicle, etc. or a tram; provided, however, that cases of operating a personal mobility device are excluded; the same shall apply hereinafter in this Article), and having had that punishment become final, again violates paragraph (1) or (2) of the same Article within ten years from the date the punishment became final (including a person whose punishment has lapsed) shall be punished according to the following classifications:

Among persons who have violated Article 44 (1), a person whose blood alcohol concentration is 0.03 percent or higher but lower than 0.2 percent shall be punished by imprisonment with labor for not less than one year but not more than five years, or a fine of not less than five million won but not more than twenty million won.
Road Traffic Act Article 152 (Penal Provisions)
A person who falls under any of the following shall be punished by imprisonment with labor for not more than one year or a fine of not more than three million won:
1. A person who, in violation of Article 43, operates a motor vehicle without having obtained a driver's license under Article 80 (excluding a motorized bicycle license; the same shall apply hereinafter in this Article) (including cases where the validity of the driver's license is suspended), or without having obtained an international driving permit or a mutually recognized foreign license under Article 96 (including cases where driving is prohibited and cases where the period of validity has expired)
