Even for part-time work, an employment contract must be written, and delaying it constitutes a violation of Article 17 of the Labor Standards Act.

When the employer concludes a contract with the employee, essential matters such as wages, working hours, job content, holidays, and contract period must be specified in writing and delivered. Violating this can result in a fine of up to 5 million won.

The employment contract must be drawn up in 2 copies, with the employer and employee each keeping 1 copy, and disguising labor as oral contract or freelance work can also constitute a violation of the Labor Standards Act.

Types of Labor Standards Act violations include ▲dismissal without justifiable cause ▲non-payment of overtime wages ▲payment below minimum wage ▲non-preparation and non-delivery of employment contract ▲disguised freelance contract etc., and if these reasons apply, you can report to the Ministry of Employment and Labor.

Reporting can be done through the Ministry of Employment and Labor website civil affairs section or nearby local employment and labor offices, and the procedure is securing supporting evidence → filing report → labor inspector investigation → corrective order or criminal prosecution.
