A payment order is a legal procedure that allows you to recover monetary claims much more simply and quickly than civil litigation.
It is a method by which the court issues an order to "pay the debt" through document review based solely on the application of the creditor (yourself) without directly summoning the debtor (the other party) to court.
First, you must submit a payment order application to the district court that has jurisdiction over the debtor's address.
In the application, attach the claim amount, the cause of the claim (such as monetary loan), and evidentiary materials.
After that, the court reviews only the documents without a separate hearing, issues the payment order, and serves it on the debtor.
At this time, if the debtor does not file an objection within 2 weeks from the date of receiving the payment order, the payment order has the same effect as a final judgment.
Once the payment order is finalized, you can carry out compulsory execution such as seizure of the other party's wages, deposits, etc.
Conversely, if the debtor files an objection within 2 weeks, the payment order is automatically converted to civil litigation procedures.
In this case, you must go through a trial like a regular lawsuit and receive a judgment.
