Workplace sexual harassment includes the following types.
(1) Physical acts: This includes physical contact such as hugging or back-hugs, touching specific body parts, and forcing massages or caresses.
(2) Verbal acts: This includes lewd jokes, vulgar talk, sexual comparisons regarding appearance, spreading sexual content, forcing sexual relations, and forcing someone to sit beside you at a company dinner and pour drinks.
(3) Visual acts: This corresponds to posting or showing lewd photos, drawings, graffiti, or publications, and intentionally exposing specific body parts.
Workplace sexual assault is a sex crime subject to criminal punishment, and can be reported and remedied.
The perpetrator faces up to 3 years of imprisonment or a fine of up to 15 million won.
(1) You can report orally or in writing to the employer or grievance officer. If the internal company procedures are inadequate, you can seek help from external institutions such as sexual violence counseling centers.
(2) If the act is serious or repeated, you can file a criminal complaint with the police or prosecutor to have the perpetrator punished.
(3) You can also file civil claims for damages for physical and mental harm, and these can be claimed within 10 years from the date of the incident.
