Q
I'm curious about the commercial claim recovery procedure.

My husband had an affair with a company employee. I found out recently and my husband begged for forgiveness. My husband apologized and we have children, so I don't want to divorce. I just want to proceed with a lawsuit against that female employee — do I have to divorce to proceed with the lawsuit against the other party? Can I not sue without divorcing?

The situation you described is a payment claim arising from commercial activities (delivery of goods) with a transaction partner, so it falls under commercial claims under Articles 46 and 64 of the "Commercial Act."
Therefore, like in your case, unpaid amounts due to delivery and credit transactions between businesses are typical examples of commercial claims.
To recover commercial claims, first send a content-certified mail to clearly notify the transaction partner of the existence of the claim and the request for payment.
At this stage, it has greater legal effect than simple verbal urging, and is also used as evidence of statute of limitations interruption "demanding fulfillment of debt" in future lawsuits.
If the debtor continues to fail to pay the amount, you can apply for a payment order to the court.
The payment order proceeds with documents only, and if the other party does not object, it is confirmed as an enforcement title (a document enabling compulsory execution).
It is widely used in commercial claim recovery because it requires less cost and time.
However, if the debtor objects to the payment order or there is a dispute over the claim amount, you must proceed with a civil lawsuit.
At this time, you can prove the existence of the claim by submitting tax invoices, transaction statements, invoices, deposit details, text messages, and emails as evidence.
For commercial claims, the burden of proof under the Commercial Act may be reduced in some cases, so even without a contract, there is sufficient possibility of claim.
The statute of limitations for most commercial claims is 5 years, so to prevent unpaid amounts from being neglected for a long time, you must interrupt the statute of limitations with a content-certified mail dispatch, lawsuit filing, or provisional attachment before the statute of limitations is completed.
