Bodily Injury Complaint Defense Case | Acquittal for a Client Charged With Infliction of Bodily Injury
The client who was the subject of a bodily injury complaint sought out a specialist attorney who had handled numerous infliction of bodily injury cases in order to defend against a situation in which their former girlfriend had filed a complaint for infliction of bodily injury.
1. The Client Who Was the Subject of a Bodily Injury Complaint

This is a case in which the client, who was charged with bodily injury, received the assistance of Daeryun’s criminal attorney in a sudden complaint situation and successfully concluded the case by obtaining a not guilty judgment on the charge of infliction of bodily injury.
The Client Charged With Infliction of Bodily Injury
Before beginning a relationship with his girlfriend, the client had been infected with a sexually transmitted disease and received treatment.
After the treatment ended and he received a negative test result, he honestly informed his girlfriend of the past infection.
The two consistently used contraceptive devices during sexual intercourse, but at the girlfriend's request, they had intercourse without using a contraceptive device.
After some time had passed, as a result of a test for sexually transmitted disease, the client received a negative result, but the girlfriend received a positive result.
Accordingly, the girlfriend filed a complaint against the client for infliction of bodily injury, and the client, feeling that this was unjust, requested help from a criminal attorney at Daeryun.
2. Bodily Injury Complaint: What Is Infliction of Bodily Injury?
Looking at Supreme Court precedents, bodily injury is the impairment of the completeness of the victim’s body or the causing of a disturbance to physiological function, and it does not necessarily have to be accompanied by an external wound.
Accordingly, if a person concealed the fact of a sexually transmitted infection and thereby transmitted the disease, that person may face a criminal complaint for infliction of bodily injury from the other party.
[Supreme Court Judgment of January 26, 1999, 98Do3732]
Level of punishment for infliction of bodily injury
| Article 257 of the Criminal Act (Bodily Injury, Bodily Injury to a Lineal Ascendant) | A person who inflicts bodily injury upon another shall be punished by imprisonment for up to 7 years, suspension of qualifications for up to 10 years, or a fine of up to 10 million won. |
Establishing the Issues in the Complaint Case
The criminal attorney organized the core issues of the case as follows.
② The cause of infection and the possibility of attributing liability for the bodily injury
In particular, the attorney focused on the point that the client had honestly informed his girlfriend of the fact of the sexually transmitted disease, and on the point that the test results showed no matching transmission route between the client and his girlfriend.
Accordingly, the criminal attorney established a strategy aimed at obtaining an acquittal, emphasizing that the client bore no liability for the bodily injury.
3. Assistance Provided on the Bodily Injury Complaint

After consultation with the client who had a bodily injury complaint filed against him, the criminal attorney provided assistance through the following strategy so that the client could deny the charge of bodily injury and obtain an acquittal.
Criminal Attorney's Argument ① | Whether the Sexually Transmitted Infection Was Disclosed
The girlfriend is claiming that the client intentionally concealed the fact of a sexually transmitted disease and had sexual relations.
Accordingly, the criminal attorney secured specific evidentiary materials such as the KakaoTalk conversation records between the two, and emphasized that the client had already informed the girlfriend of the fact of the sexually transmitted disease.
Criminal Attorney's Argument ② | No Source of Infection
The client underwent a sexually transmitted disease test at a hospital, and the test result was negative.
The girlfriend, on the other hand, received a positive result, but there was no type of sexually transmitted disease that matched between the two test results.
Accordingly, the criminal attorney secured specific materials such as the test records, treatment histories, and medical opinions of the client and the girlfriend, and emphasized that the possibility could not be ruled out that the girlfriend had been infected through a route other than the client, or had already been infected before meeting the client.
4. Result of the Assistance With the Bodily Injury Complaint: “Acquittal”

As a result of the assistance with the bodily injury complaint, the court rendered an acquittal on the charge of infliction of bodily injury.
Accordingly, the client was able to amicably conclude the bodily injury case without criminal punishment.
