Although real estate inheritance procedures may seem like a simple registration transfer issue on the surface, in reality, detailed review such as identifying the scope of heirs, classifying inherited property by type, and identifying rights and obligations as of the date of death is necessary.
Documents to be submitted to inherit real estate are divided into basic documents prescribed by law and additional documents that vary depending on the composition of heirs or the type of real estate.
Errors at this stage can lead to not only registration delays but also inheritance tax penalty issues and disputes among heirs, so careful preparation is necessary.
First, documents related to confirming heirs are most important. Basically, the deceased's basic certificate, family relationship certificate, marriage relationship certificate, the heirs' basic certificates, family relationship certificates, resident registration extracts, etc. are required.
Next, real estate inheritance documents include real estate registry extracts, land registers or building registers, cadastral maps and forest maps, and documents to confirm shared ownership status.
Documents differ depending on whether it is land or building, and whether it is sole ownership or shared ownership. For buildings, whether it is an unauthorized building or unregistered building must also be reviewed.
If the heirs make agreements on division of inherited property, an inheritance property division agreement is essential.
The agreement must be personally signed and sealed by all heirs, and there are many cases where registration is rejected if the seal is incorrectly affixed or the seal certificate is omitted.
