Q

School violence measures: can the victim student and the perpetrator student be separated?

Legal IntellectualViews39,708

Hello. It turns out my child had been suffering school violence for nearly a year. As their mother, I feel so sorry that I did not realize how hard it was for my child.. Today I spoke with my child's homeroom teacher and filed a report. If I file a report, can the victim student and the perpetrator student be kept separated? After filing a report, what happens with the school violence measures against the perpetrator?

Answer to Related Inquiry

You have inquired about school violence measures. First, I will explain the separation of the victim student and the perpetrator student.

If the school principal becomes aware of school violence, then absent special circumstances, the victim student and the perpetrator student must be separated without delay.

If the victim student's wish to be separated has been confirmed, the method of separation is decided within 24 hours, and they can be separated from the perpetrator student.

However, because such separation lasts for up to 7 days, if an emergency measure against the perpetrator student is requested, the student can be separated from the perpetrator student even before the School Violence Committee's deliberation and resolution.

If the School Violence Committee's deliberation has taken place, not only the perpetrator but also the victim can be subject to school violence measures.

Where it is deemed necessary to protect the victim student, protective measures such as psychological counseling, care for treatment, and a change of class are provided.

In addition, the perpetrator may be subject to different measures depending on the case, such as a written apology, a prohibition on approaching or retaliating, community service inside or outside the school, completion of special education, suspension of attendance, a change of class, a transfer, and expulsion.

If you have a School Violence Committee hearing ahead, it is important that your child state the facts of the harm consistently, and that you collect evidence and materials that can prove the harm.

Based on this, you may wish to prepare in advance a statement that can be presented at the School Violence Committee.
