Q
A court-appointed attorney has already been assigned, so is it possible to retain a private attorney?
Views42,245
A court-appointed attorney was assigned to my family member who was detained in a criminal case, and I have now managed to raise some money by borrowing from several sources. Even at this stage, I would like to find another attorney or law firm so that my family member can be represented by an attorney we are satisfied with. Perhaps it is only my impression, but the current attorney does not seem to be paying proper attention, and my family member says communication is difficult, which troubles me as well. I would like to ask whether it is possible to switch back to a privately retained attorney.

Even after a court-appointed attorney has been assigned, you may still entrust your case to a privately retained attorney who specializes in your particular matter.
Once a privately retained attorney is engaged and the notice of appointment is filed, the court-appointed attorney is automatically discharged.
A court-appointed attorney offers the advantage that the defense can be provided free of charge; however, because such an attorney is designated by the State, there is a possibility that it may become difficult to devote a great deal of time and full dedication solely to the defendant.
If the matter for which your family member is suspected is a complex criminal case with many points that can be reasonably contested and that involves injustice, we recommend retaining a privately retained attorney.
In addition, because we can represent you in reaching a settlement with the victim and present criminal evidence that the investigative agency did not uncover, thereby establishing a defense strategy, we recommend retaining a privately retained attorney again.
A privately retained attorney can respond immediately when an attorney visit is needed even while a person is detained, so you may wish to consider this carefully before making a decision.
Daeryun Law LLC has attorneys specializing in various fields, including criminal law, sexual offenses, school violence, corporate legal affairs, divorce, inheritance and family matters, real estate, civil law, administrative law, and insolvency, and establishes assistance measures suited to each client's case, so if you need to retain a private attorney, we recommend reviewing your options through a consultation with a criminal law attorney at our firm.
