The statute of limitations basically varies depending on the punishment prescribed for the offense.
- Death penalty: permanent ~ 25 years
- Life imprisonment/imprisonment without labor: 15 years
- Imprisonment/imprisonment without labor of 10 years or more: 10 years
- Imprisonment/imprisonment without labor of 5 years or more and less than 10 years: 7 years
- Imprisonment/imprisonment without labor of less than 5 years, fine: 5 years
For indecent assault, since the statutory punishment is imprisonment of up to 10 years or a fine of up to 15 million won, the statute of limitations should be calculated as 10 years.
Please note that for sexual violence crimes, complaints and reports can be filed at any time as long as the statute of limitations remains.
