④ Overtaking and cutting in

⑤ Violation of the method of crossing a railroad crossing

This refers to a case of passing straight through a railroad crossing without stopping or in disregard of the signal.

⑥ Violation of the duty to protect pedestrians at a crosswalk

This refers to a case of causing an accident by proceeding without yielding to a pedestrian crossing at a crosswalk.

⑦ Driving without a license

This refers to a case of driving without a driver's license or a construction machinery operator's license, or of driving while the license is suspended or revoked.

⑧ Driving under the influence of alcohol or drugs

This refers to a case of drunk driving (a blood alcohol concentration of 0.03% or higher) or of driving in a state in which normal driving is difficult after taking drugs.

⑨ Encroachment on the sidewalk and violation of the method of crossing the sidewalk

This refers to a case in which a vehicle enters the sidewalk, or crosses the sidewalk without taking safety measures.

⑩ Violation of the duty to prevent passengers from falling

Where a driver departs or operates the vehicle without securing the safety of passengers on board, and a passenger falls, this is regarded as gross negligence.

Administrative Disposition

An accident involving one of the 12 categories of gross negligence also meets the criteria for an administrative disposition of a license under the Road Traffic Act, so a suspension or revocation of the driver's license may be imposed.

When a driver's license is revoked, a disqualification period is imposed during which the license cannot be reacquired, and the length of that period depends on the underlying ground.

Only after this disqualification period has elapsed can the reacquisition procedures, such as applying for the license examination, proceed.

In addition, after the disqualification period has passed, the driver must complete the mandatory special traffic safety education before the driver's license can be acquired.
