1. Serious Citizen Accident | A Law to Ensure the Life and Safety of the Public

As large-scale casualty accidents recurred, it came to be recognized that the Occupational Safety and Health Act alone could not sufficiently protect the lives and safety of the public, giving rise to the concept of a serious civic accident.
To address this, the Serious Accidents Punishment Act, in force since 2022, includes and regulates ‘serious civic accidents,’ which cover cases in which an unspecified number of members of the public suffer harm due to a public-use facility, a means of transportation, or a defective manufactured product.
A serious civic accident refers to a case in which ordinary citizens, consumers, or users, rather than workers employed at a particular factory or workplace, suffer harm.
Examples include cases in which nearby residents suffer harm from a chemical leak at a factory, cases in which visitors are injured or killed when a public-use facility such as a large shopping mall collapses, and cases in which consumers sustain serious injury or illness due to a defective product (manufactured product).
Examples of a Serious Citizen Accident
When the Serious Accidents Punishment Act applies, the following cases may be judged to be serious civic accidents.
Accidents caused by a manufactured product
- An incident in which heated insulating oil spilled from inside a transformer-rectifier, causing full-body severe burns and death
- An incident at a hospital in which a muscle relaxant was administered, causing one death and a mass shock accident
Accidents caused by a raw material
- An incident in which humidifier disinfectant resulted in approximately 8,000 persons filing claims for harm
- An incident in Gumi in which a hydrofluoric acid gas leak caused harm, including five deaths and twelve serious injuries
2. Serious Citizen Accident | Requirements to Be Met

A serious citizen accident is established only when it satisfies the requirements prescribed by law.
It is broadly divided into the following 3 cases.
- Fatal accident
If 1 or more deaths occur due to a defect in the design, manufacture, or management of a specific raw material, manufactured product, public-use facility, or public means of transportation, it is classified as a serious citizen accident, where 1 or more deaths occur. - Large-scale injury accident
If 10 or more injured persons requiring treatment of 2 months or more arise from the same accident, that accident is included as a serious citizen accident. - Large-scale disease accident
Even where 10 or more persons with a disease requiring treatment of 3 months or more arise from the same cause, it is regarded as a serious citizen accident.
A simple small-scale accident does not qualify, and the protection of this Act can be received only when serious harm to human life of a certain scale or more occurs.
The Scope in Which a Serious Citizen Accident Arises
① Public-use facilities
These refer to buildings or facilities used by many people that are of a certain size or larger as prescribed by Presidential Decree. Small shops of small business owners and educational facilities such as schools are excluded.
Public-use facilities among facilities | Large shopping malls, performance halls, sports facilities, subway stations, underground shopping arcades, waiting rooms, passenger terminals, etc. |
Public-use facilities among structures | Road and railway bridges, tunnels, harbor structures such as breakwaters, dams, buildings (cultural and assembly facilities and religious facilities with a total floor area of 5,000 square meters or more, etc.), rivers, etc. |
② Means of transportation
Public means of transportation include urban railways (subways), railways, route buses, passenger ships, and aircraft used by an unspecified number of people.
Dedicated railways and certain special means of transport are excluded.
③ Raw materials and manufactured products
Manufactured products include all goods made in factories, and various items used by ordinary consumers, such as electronic products, automobiles, and food, may all fall within this category.
Here, raw materials and the like are subject to application without limitation in scope, covering all raw materials and manufactured products.

- Toxic gases
- Pesticides, natural plant protection agents, and fertilizers
- Narcotics and hazardous chemical substances
- Biocidal substances and products
- Food and food additives
- Medical devices and quasi-drugs (including those for animals)

3. Serious Citizen Accident | The Employer's Duty to Ensure Safety and Health

To prevent serious civil accidents, the law imposes clear obligations on business owners and responsible managers.
What ordinary citizens and victims should keep in mind is that, when an accident occurs, it should not simply be attributed to an individual's carelessness.
Whether the business owner or responsible manager fulfilled the duty to ensure safety and health is of great importance, and business owners and responsible managers must carry out the following measures.
If these obligations are not fulfilled, the business owner or responsible manager bears criminal liability and liability for damages.
Obligations in Contracting, Service, and Consignment Relationships
In modern society, the management and operation of public-use facilities or means of transport are often subcontracted or entrusted to outside parties.
In such cases, if the original business operator substantively controls, operates, and manages the facility, it cannot escape the duty to ensure safety even though the matter was entrusted to a third party.
In other words, when determining where responsibility lies, an accident victim may hold liable not only the company entrusted with operations but also the original business operator (the principal contractor).
What is substantive control, operation, and management responsibility?
The law regards a company or corporation as substantively controlling, operating, and managing the facilities, manufactured products, and similar items in the following cases.
① Where it holds rights over the place, facility, or equipment, such as ownership, the right of possession, or a leasehold
② Where it can control the hazards and risks arising from raw materials or manufactured products being produced, manufactured, sold, or distributed by the business or workplace
③ Where it has a duty to manage the items safely by carrying out repairs and reinforcement
Reporting and Measures When an Accident Occurs
When a serious civil accident occurs, the safety and health officer must report it to the police and fire stations.
After reporting the situation to the administrative agency without delay, the officer must carry out emergency relief measures for the casualties and emergency safety measures, and the responsible manager must be made aware of the occurrence immediately.

- Status of on-site emergency response and evacuation
- Contact information of the reporter and the person in charge of the workplace
4. Serious Citizen Accident | Criminal Liability and Damages for Violations
When a serious citizen accident occurs, a business owner or chief executive officer who has failed to fulfill the duties prescribed by law is subject to the following punishment.
- A serious accident such as a fatal accident : imprisonment for at least one year or a fine of up to 1 billion won (the imprisonment and fine may be imposed concurrently)
- A large-scale injury or illness accident : imprisonment for up to seven years or a fine of up to 100 million won
- Joint penalty provision for a corporation : a fine of up to 5 billion won for death, and up to 1 billion won for injury and illness, may also be imposed on the corporation
In other words, a chief executive officer who violates the law may be subject to an actual (custodial) sentence personally, and a fine may be imposed on the company as well.
However, if it is proven that the corporation or institution exercised considerable care and supervision to prevent the safety accident, the punishment may be exempted.
Punitive Damages of up to Five Times
An important matter for victims is precisely the matter of damages.
If a business owner or chief executive officer violates a duty through intent or gross negligence and a serious citizen accident occurs, the victim may claim damages of up to five times the amount of the loss.
The court determines the amount of damages by comprehensively considering the following matters.
This is a system intended to allow the victim to receive substantially sufficient compensation.
5. Serious Citizen Accident | Public Disclosure of Businesses and Requests to Victims

When a serious civic accident occurs, the Minister of Employment and Labor may disclose to the public the name of the workplace where the accident occurred, the date and time, the place, and the content and cause of the accident, among other things.
This is intended to prevent similar accidents and raise awareness.
In addition, in the criminal trial the court may examine the victim or the bereaved family as witnesses, and a specialized adjudication adviser may participate to secure expertise and enhance fairness.
