When a Jeonse-Rented Home Is Sold, Does the Security Disappear Too? Supreme Court Ruling Clarifies When the Opposing Power Lapses

In a case concerning whether a tenant who personally purchases a home in which they had been living under a jeonse (lump-sum deposit lease) retains the previously acquired right of opposing power and priority right to repayment, the Supreme Court held that these rights are extinguished at the moment ownership is acquired. The lower court found that the tenant lost both the right of opposing power and the priority right to repayment upon acquiring the home, and that this accordingly gave rise to grounds for exemption under the guarantee terms of the jeonse deposit safety loan. The Supreme Court likewise upheld this finding, ruling that once the tenant's possession can no longer be regarded as possession based on the leasehold, the resident registration loses its function as a method of public notice and the right of opposing power is extinguished at the time ownership is acquired.
