Coercion, which many people confuse, is an offense provided for in Article 324 of the Criminal Act; it is established where a person, through assault or intimidation, obstructs another's exercise of a right or compels another to do something the other is not obligated to do, and the person may be subject to imprisonment for not more than five years or a fine of not more than thirty million won.
Understanding the Protective Measures System
Providing protection to the victim of a crime where the victim suffers, or is at risk of suffering, harm from the perpetrator during the criminal proceedings is referred to as the protective measures system.
Such protective measures are carried out under the following statute.
(1) Where a crime informant or the like, or a relative or the like thereof, is at risk of suffering retaliation, a prosecutor or the chief of a police station may, for a certain period, have a public official belonging to the relevant prosecutors' office or police station take measures necessary for personal safety (hereinafter “measures for personal safety”), or may request the chief of the police station having jurisdiction over the residence or present location of the person concerned to take measures for personal safety. In such a case, the chief of the police station who receives the request shall, in the absence of special grounds, take measures for personal safety immediately.
Protection is provided ranging from temporary personal security to tailored patrols of the victim's residence and accompaniment when the victim appears before a court or an investigative agency to give a statement.
Personal protection may be received primarily by the victim who is at risk of suffering retaliation from the perpetrator, as well as by informants, witnesses, persons providing reference statements, and their family members, and one may make an inquiry to the victim liaison officer at each police station or to the victim support office at the prosecutors' office.
