1. The Client Who Suffered Stalking
This is the account of the Client who sought an attorney's assistance, stating that the Client was a victim of stalking.
The Client was in such extreme fear that the Client was afraid to go outside, so the attorney decided to hold a video consultation in consideration of the Client's situation.
The account the attorney heard from the Client through the video consultation was as follows.
The Client explained that there had been a former partner whom the Client had dated for about a month, and that this former partner, A, had shown something strange even before they started dating.
Although they were not in a relationship, A had shown obsessive behavior, such as sending endless messages through social media and coming to the Client's home.
The Client explained that, thinking it was because A liked the Client very much, the Client accepted A's feelings and began dating.
Throughout the relationship, the Client explained, A would curse if the Client did not check a message even for 10 minutes and would suspect that the Client was seeing other men.
When the Client could not endure it and announced the breakup, A came to the Client's home, choked the Client, made a scene, and used violence.
The Client explained that, even while suffering such dating violence and stalking, the Client was unable to file a complaint out of fear of retaliation and stayed only at home.
What Stalking Is

Stalking refers to engaging in stalking acts continuously and repeatedly.
Under the 🔗Act on Punishment of Crime of Stalking, the following acts qualify as stalking acts.

ㆍCausing objects, writing, words, signs, sounds, pictures, video, or images to reach the other party and the like by mail, telephone, fax, or an information and communications network, or causing writing, words, signs, sounds, pictures, video, or images to appear to the other party and the like through a program or telephone function that uses an information and communications network
2. Assisting the Client Who Was a Stalking Victim
For the Client who was a stalking victim, the attorney decided to provide assistance as follows.
Representation in Filing a Complaint for a Client Harmed by Stalking
The attorney filed a complaint on behalf of a client harmed by stalking as follows.
Even after the client gave notice of ending the relationship and explicitly asked that there be no further contact, A sent approximately 200 messages containing content that caused anxiety or fear.
A also attempted to call the client a total of 30 times, repeatedly and continuously causing written and other communications to reach the client through an information and communications network without justifiable grounds and against the client's will, causing the client anxiety and fear.
Accordingly, the attorney requested that A be charged with stalking and punished severely.
Protection of a Client Harmed by Stalking
The attorney undertook personal protection for a client harmed by stalking.
The attorney conducted a risk assessment in cooperation with the firm's security center.
The assessment found that the client faced a high risk of being harmed by stalking again, given A's strong tendency toward violence and need for control, the fact that much of the client's personal information had already been exposed, and the fact that A was currently not in detention.
The security center therefore decided to anticipate situations that could arise for the client and to prepare for them in advance.
The center also decided to accompany the client through every stage of the proceedings, from the police investigation to the trial, to help the client overcome psychological anxiety.
The security center provided protection with the client's personal safety as the top priority, from the client's home to the police station and back home again.
Protection Procedure for a Client Harmed by Stalking
