Q
Are military sex crimes different from general sex crimes?
Vues6,877
I recently received a summons to appear before the Central Public Officials Disciplinary Committee. The summons includes an explanation of the disciplinary reasons, but I'm not sure how to defend myself. I'd like to know what to prepare when appearing before the Central Public Officials Disciplinary Committee and how to respond.

Military sex crimes are punished much more strictly than general sex crimes.
The reason is the special nature of the military organization.
Military sex crimes are not simply crimes between individuals, but lead to a decline in military unity and morale, and can further lead to a weakening of national defense.
In addition, the military is a closed environment, and there are many cases where victims are placed in disadvantageous positions in relationships with superiors or colleagues, so the degree of damage may be greater.
The Military Criminal Act applies not only to active officers, warrant officers, non-commissioned officers, and privates, but also to officer candidates, civilian military personnel, and other persons with military status, and sex crimes that occur during service can be punished even after discharge.
The most common type of military sex crime is sexual molestation, which is separately stipulated in Article 92-3 of the Military Criminal Act.
If a soldier sexually molests another soldier through assault or threat, they can be sentenced to imprisonment of 1 year or more, which has a big difference compared to indecent assault under the general Criminal Act in that there is no fine sentence and the possibility of an actual prison sentence is high.
If you have more questions related to military sex crimes, I recommend consulting with a military criminal specialist attorney to confirm the specific contents of the case, the possibility of punishment, and response measures.
