I committed several crimes at the same time. How is the punishment for concurrent crimes determined?

Concurrent crimes are when one person commits multiple crimes at the same time.

The Criminal Act provides for concurrent crimes that when there is no room for discretionary mitigation, that is, no room for sentence reduction, the long term and short term of the sentences are added together.

Therefore, as the maximum limit of punishment, it can be punished up to 1.5 times the legal maximum sentence, as stipulated (refer to Articles 37 and 38 of the Criminal Act).

Also, even if it is increased to 1.5 times, it cannot exceed the term and amount of the long term or large amount of each sentence added together.

For concurrent crimes, sentences may be pronounced separately for each crime, and the court may also reduce the sentence at its discretion.

In particular, only crimes before the sentence becomes final are recognized as concurrent crimes.

If one criminal act constitutes multiple crimes, it is punished by the sentence prescribed for the most serious crime.

Article 37 of the Criminal Act (Concurrent Crimes) Several crimes for which sentences have not become final, or crimes punishable by imprisonment or higher whose sentences have become final and crimes committed before such sentences become final, shall be concurrent crimes.

1) When the sentence prescribed for the most serious crime is the death penalty, life imprisonment, or life imprisonment without labor: punished by such sentence

2) When the sentences are of the same kind other than the death penalty, life imprisonment, or life imprisonment without labor: the long term or large amount of the sentence prescribed for the most serious crime is increased by half

3) When the sentences prescribed for each crime are sentences other than life imprisonment or life imprisonment without labor: imposed concurrently

4) Imprisonment and imprisonment without labor are regarded as the same type of sentence and punished as imprisonment
