Q
Military criminal attorney! Does the Military Criminal Act also apply to noncommissioned officer candidates?

I would like to know whether the Military Criminal Act also applies to noncommissioned officer candidates. I understand it is a law that punishes soldiers when they do wrong, but are noncommissioned officer candidates also treated as soldiers and subject to punishment under the Military Criminal Act? Or is there a separate provision? To a military criminal attorney or expert who knows well about military cases, I would appreciate a detailed explanation.

Yes, that is correct. Noncommissioned officer candidates are also subject to the Military Criminal Act. The persons to whom this Act applies are as follows.
① Soldiers of the Republic of Korea (officers, warrant officers, noncommissioned officers, and enlisted personnel) *except enlisted personnel undergoing converted service
② Military civilian employees
③ Students and cadets of military schools who hold military registration, officer candidates and noncommissioned officer candidates, and students in residence who hold military registration under Article 57 of the Military Service Act
④ Reservists, supplementary service personnel, and wartime labor service personnel who have been called up and are serving as soldiers
In addition, even a civilian unrelated to the military is subject to the Military Criminal Act on a par with a soldier where they commit espionage, the supply of harmful food to the military, or an offense against a sentry.
Beyond this, the Military Criminal Act also maintains the order of the military and prescribes punishment for various violations that occur within the military.
To accurately understand the legal procedures in military-related crimes and respond systematically, it is advantageous to seek advice from a military criminal attorney with abundant experience in handling such cases.
It is advisable to conduct a close consultation with a military criminal attorney to clearly grasp the legal issues and steer the case favorably.
