1. The Circumstances of the Unfair Competition Prevention Act Dispute

The client against whom a lawsuit was filed in connection with the Unfair Competition Prevention and Trade Secret Protection Act was a household goods manufacturer.
The client was sued in a lawsuit seeking an injunction against an act of unfair competition, but with the court's judgment dismissing the claim, was ultimately able to win the case and conclude the matter.

2. The Unfair Competition Prevention Act and the Issues in the Case

▷ Registering or using, without a legitimate basis, a domain name similar to another person's trademark or trade name
If a company suffers actual harm to its business as a result of an act of unfair competition, it may claim damages for such harm and may have the act stopped so that it does not continue.

In the case of the right to claim prohibition, it must be exercised within three years from the date on which the person who committed the act of unfair competition became known, and the right is extinguished when 10 years have passed since the act of unfair competition.
What Are the Issues in the Case?
In the client's case, the opposing party had brought the lawsuit claiming, even though the design elements in question were elements generally used throughout the industry, that these were its own distinctive design.
The key issue was whether the product design asserted by the competitor had in fact been used exclusively and continuously for a long time in the relevant industry and had come to be uniquely recognized by consumers.

Another subject of judgment was whether the design elements at issue, such as natural images or color schemes, were general elements conventionally used throughout the industry, or were creative, distinctive, and original expressions.
3. Unfair Competition Prevention Act Dispute: Assistance Provided

In order to qualify as a 'mark indicating the goods of another that is widely recognized within the country' and thus receive protection under the said Act, the form of the goods must, in comparison with other similar goods, possess a distinctiveness sufficient for an ordinary consumer to recognize at a glance that the goods belong to a particular business entity, such as by having a unique design feature that strongly appeals to consumers' senses, and furthermore the form of the goods in question must have been used continuously, exclusively, and on a monopoly basis as the goods of a particular business entity over a long period, or, even over a short period, through strong promotion and advertising, the distinguishing features of the goods' form must have reached the point of being so markedly individualized as to cause traders or ordinary consumers to associate the goods with a particular source.
Demonstrating the Common Nature of the Design Elements and Industry Practice
Through comparative materials, we proved that the design element at issue belonged to the general, non-exclusive public domain that is commonly used throughout the industry.
Through this, we made it clear that the design was not an original, distinctive expression, and we used this as a key basis for rebutting the other party's claim of exclusive rights.
In addition, we submitted to the court a report analyzing the history of past use and market practice, thereby enhancing the credibility of the public nature of the design.
4. Result of the Unfair Competition Prevention Act Dispute: “Favorable Judgment”

The court held that it was difficult to regard the design claimed by the other party as an original design, and difficult to find that the client's product had copied it, and dismissed the plaintiff's claim.
As a result, the client was able to continue normal distribution without halting product sales, and was also able to protect the brand image.
