Q
How do I file a wage non-payment report?
Vues6,822
Hello. I'm an ordinary office worker. I recently downloaded a few movies for free via torrent, and someone contacted me saying they filed a copyright infringement complaint. I simply downloaded movies — I had no idea about 'uploading' or 'distribution.' Can I still be punished for copyright law violation in this case? Please reply about how to respond.

The situation you described is a typical wage non-payment case that constitutes a violation of the wage payment obligation under Article 43 of the 「Labor Standards Act」.
In other words, when the employer does not pay wages or severance pay, which are the consideration for labor, on the agreed payment date, the worker can receive legal protection through a wage non-payment report.
Wage non-payment reports can be made by directly visiting the local employment and labor office (Labor Inspector's Office) of jurisdiction or online through the Ministry of Employment and Labor website (Civil Service Hall → Wage Non-Payment Petition).
When reporting, you must submit materials proving the labor relationship and the fact of non-payment together, such as the labor contract, salary statement, and bank account records.
Once the report is received, the labor inspector will request the company to appear and, after confirming the facts, will issue a wage payment order or corrective instruction.
If the employer does not implement this, they may be punished with imprisonment of up to 3 years or a fine of up to 30 million won under Article 109 of the「Labor Standards Act」.
Meanwhile, to quickly receive unpaid wages, workers can directly exercise their rights through civil procedures (payment order, civil litigation) or provisional attachment applications.
In addition, free legal consultation and litigation representation support can be received through the Korea Legal Aid Corporation. Workers whose average wage for the 3 months before retirement is less than 4 million won are eligible for relief.
