If you report stalking damage, the police will take protective measures appropriate to the situation under the "Act on the Punishment of Stalking Crimes."
First, when a stalking crime is reported, the police dispatch officers to the scene to stop and halt the stalking act, separate the perpetrator and victim, and implement emergency measures notifying in writing of the possibility of punishment in the event of future violations (Article 3 of the Act).
If there is a risk that stalking acts will be repeated and urgency is required, the police may, on condition of subsequent approval, order an approach prohibition within 100m or an approach prohibition through electronic communications for up to 1 month (Articles 4 and 5 of the Act).
If the perpetrator violates this, they are subject to imprisonment of up to 1 year or a fine of up to 10 million won (Article 20(3) of the Act).
In addition, if there is a high risk of recidivism, the prosecutor can apply to the court to obtain a decision for measures such as approach prohibition, prohibition of approach via electronic communications, and detention in a holding cell for up to 3 months (extendable) (Articles 8 and 9 of the Act).
Violations are punishable by imprisonment of up to 2 years or a fine of up to 20 million won (Article 20(2) of the Act).
Even when the Stalking Punishment Act does not apply, you can apply for an injunction prohibiting approach under the "Civil Execution Act" or an approach prohibition order under the "Act on Special Cases concerning the Punishment of Domestic Violence Crimes."
When a stalking crime occurs, immediately reporting to the police (112) and securing possible evidence (call records, messages, CCTV, etc.) is important for safety and legal protection.
