A man who was handed over to the prosecution on charges of extorting a large amount of donations from Internet broadcast viewers by promising marriage to them was not indicted.
On the 26th of last month, the Seoul Western District Prosecutors' Office decided not to indict Mr. A, in his 30s, who was sent on charges of fraud.
In 2024, Internet broadcaster A was accused of embezzling money worth 200 million won by requesting sponsorship from his channel viewer B under the pretext of marriage.
Mr. B's side claimed that Mr. A started dating because he expressed interest, but when financial support was cut off, the relationship was unilaterally cut off, and that he was psychologically exploited during the dating process and suffered enormous damage.
Person A denied the charges.
All of the money sent by Mr. B was in the name of voluntary sponsorship, and in fact, he also gave money to Mr. B for reasons such as hospital expenses.
At the same time, Mr. A also emphasized that he once offered to return the donations he received.
In addition, he refuted that he had requested a face-to-face meeting with Mr. B several times, but was rejected. Afterwards, he found out that even the photos and personal information he received were false, so he only notified him of the breakup.
The prosecution decided not to indict Mr. A.
The prosecution said, “The property acquired by the suspect appears to have been given voluntarily by the complainant, and there are no circumstances to suggest gaslighting. If the complainant truly believed that she would marry the suspect, there is no reason to present false personal information or avoid meeting him face to face.”
He added, "The suspect's statement that they broke up after learning of false personal information is credible, and considering this, it is difficult to acknowledge the suspect's intention to deceive. Even if the suspect's intention to deceive is acknowledged, there is insufficient evidence to prove the causal relationship with the act of providing property."
Attorney Yang Ki-yeon of Daeryun Law Firm, who represented Mr. A, explained, "In order to establish a crime of fraud, the causal relationship of deceiving others and leading them into a mistake and receiving property must be recognized," and added, "By delving into the contradiction that Mr. B avoided face-to-face encounters by presenting false identities, we were able to obtain an acquittal by proving that Mr. A had no intention to deceive."
