[Daeryun Newsletter] Theft of a Choco Pie from the break room: will it be 'not guilty' on appeal?

'At least Jean Valjean's loaf was big'—guilty of theft for eating a Choco Pie?

Jean Valjean, the protagonist of Victor Hugo's novel Les Misérables, is sentenced to five years in prison for stealing a single loaf of bread to feed his starving family. Recently, a case dubbed a "modern-day Jean Valjean" has emerged in Korea as well. An employee, identified as A, who worked for a subcontractor of a logistics company, was discovered eating snacks such as Choco Pies and custard cakes in the break room, and was subsequently sued by the company for theft. The amount in question was a mere 1,050 won. The trial court sentenced A to a fine of 50,000 won. However, if this ruling becomes final, A would fall under the disqualification grounds of the Security Services Act and face the risk of losing his job. A is therefore continuing the case, asserting his innocence on appeal. We examine the legal implications surrounding the so-called "Choco Pie theft case," in which the prosecution, the court, and the labor union each take differing views.
