Q
I was a victim of semi-jeonse fraud — can I get my deposit back?
浏览量8,365
I have a question about parking hit-and-run punishment and fines. When I went to work this morning, someone had completely scratched my car. I don't even know when they scratched it — not getting any contact is really infuriating. Unfortunately, the dash cam was off, so I'm not sure if I can catch them. Can I catch them through parking lot CCTV? I'm really wondering about parking hit-and-run punishment levels.

Hello. This is the real estate specialist attorney from Daeryun Law Firm.
I imagine you are very frustrated and anxious as a victim of semi-jeonse fraud.
Although 'semi-jeonse fraud' is not a formal legal term, it refers to a situation where, after concluding a contract with a relatively low monthly rent against a high deposit amount, the lessor does not return the deposit or has no ability to return it.
Semi-jeonse fraud can also be legally addressed in the same way as jeonse fraud.
First, it is good to send a content-certified mail setting a deadline for deposit return and stating your intent to take legal measures if not fulfilled.
Since you are in a situation where you need to move, it would be good to apply for a lease registration order with the court.
If you have completed all this and still have not received your deposit back, you can file a deposit return claim lawsuit to obtain a court ruling and then proceed with compulsory execution procedures against the lessor to get the deposit back.
If you wish, you can also review whether the crime of fraud is established and proceed with a criminal complaint.
If you need legal assistance to resolve the semi-jeonse fraud situation, please request a consultation right now.
