[Construction Law] Changes from the Amendment of the Standard Contract for Private Construction Works

The revised standard construction contract recently announced by the Ministry of Land, Infrastructure and Transport goes beyond a mere change of format; at its core are substantive institutional improvements such as distributing construction risk, protecting subcontractors, and responding to surging material costs. Adjusting the burden of inspection costs, expanding the grounds for extending construction periods, and easing the requirements for adjusting material costs are all measures intended to reduce construction companies' practical burdens and enhance business stability. In particular, practical responses such as ensuring consistency between prime and subcontract agreements and overhauling contract-negotiation processes have grown in importance. When it comes to managing contract risk, now is the time to review.

Seoul and Gyeonggi Province have sharply strengthened their crackdown on construction paper companies. Firms that participate in bids without actual construction capability, or that satisfy registration requirements only nominally through dual-employed engineers or ghost offices, may face not only administrative measures such as bidding restrictions and cancellation of registration but also criminal punishment. Companies preparing for public bids must be sure to verify their technical-personnel requirements and the genuine existence of their funds and office space before bidding.

In the first quarter of 2025, more than half of all industrial-accident fatalities occurred in the construction industry. Despite the enforcement of the Serious Accidents Punishment Act, accidents have not declined, and legal liability is in fact concentrated on the heads of small construction companies. Recurring accidents such as falls, collapses, and entrapments require both advance prevention and the satisfaction of legal requirements. Building an on-site, effective, and demonstrable safety-management system is both a corporate survival strategy and a minimum line of defense. Amid the worst-ever construction downturn, safety is now not a choice but a matter of "management."

Small and medium-sized construction sites experience frequent changes in work environment and have limited resources. This makes effective safety management all the more important. Through its "Guide to Conducting Risk Assessment Centered on Continuous Evaluation at Small and Medium-Sized Construction Sites," the Ministry of Employment and Labor has strengthened the role of supervisors and proposed a shift toward implementation-focused assessment. Identifying hazards, securing worker participation, and recording corrective measures are all directly tied to a company's legal liability.
