The revised standard construction contract recently announced by the Ministry of Land, Infrastructure and Transport goes beyond a mere change of format; at its core are substantive institutional improvements such as distributing construction risk, protecting subcontractors, and responding to surging material costs. Adjusting the burden of inspection costs, expanding the grounds for extending construction periods, and easing the requirements for adjusting material costs are all measures intended to reduce construction companies' practical burdens and enhance business stability. In particular, practical responses such as ensuring consistency between prime and subcontract agreements and overhauling contract-negotiation processes have grown in importance. When it comes to managing contract risk, now is the time to review.

Construction industry fatalities still at the highest levels—do small construction firms have a response strategy?

In the first quarter of 2025, more than half of all industrial-accident fatalities occurred in the construction industry. Despite the enforcement of the Serious Accidents Punishment Act, accidents have not declined, and legal liability is in fact concentrated on the heads of small construction companies. Recurring accidents such as falls, collapses, and entrapments require both advance prevention and the satisfaction of legal requirements. Building an on-site, effective, and demonstrable safety-management system is both a corporate survival strategy and a minimum line of defense. Amid the worst-ever construction downturn, safety is now not a choice but a matter of "management."
